FSO Variance Request Form
Ohio Administrative Code 3717-1-03.4 states that certain activities within a licensed food service operation require a variance from the Director of Health. Activities that require a variance include:
- Smoking food as a method of food preservation (does not include smoking for flavor enhancement only)
- Curing food
- Using food additives or acidification as a method of preservation or to make a food shelf-stable
- Packaging foods in reduced oxygen packaging in a manner that does not comply with the Ohio Uniform Food Safety Code
- Operating a molluscan shellfish life-support system display tank to store shellfish offered for human consumption
- Custom processing of animals for personal use (not for retail sale)
- Pressing or bottling juice in a manner that does not comply with the Ohio Uniform Food Safety Code
- Using a heat-treatment dispensing freezer in a manner that does not comply with the Ohio Uniform Food Safety Code
- Preparing food by another method determined to require a variance
- Sprouting seeds or beans
- Other activities or processes that do not comply with the Ohio Uniform Food Safety Code
