Hospitals

Chapter 3722 of the Ohio Revised Code requires hospitals operating in Ohio to be licensed by the Ohio Department of Health. The rules for licensing hospitals in Ohio can be found in Chapter 3701-22 of the Ohio Administrative Code. Additional hospital requirements can be found in Ohio Revised Code Chapter 3727.

Security Plans

House Bill 452 of the 135th General Assembly requires each hospital system and each hospital that is not part of a hospital system to establish a security plan for preventing workplace violence.

Hospitals 

Ohio Revised Code (ORC) Chapter 3722 and Ohio Revised Code Chapter 3727 outline state laws for hospitals in Ohio. The rules for licensing hospitals in Ohio can be found in Chapter 3701-22 of the Ohio Administrative Code (OAC).

Prior to Sept. 30, 2024, Ohio law required hospitals to be registered with ODH, not licensed. With the transition, hospital reporting under the registration program ended with the 2024 report submission. New reporting requirements under hospital licensure are being developed and hospitals will be notified when reporting requirements are in place. “Hospital” refers to an institution or facility that provides inpatient medical or surgical services for a continuous period longer than 24 hours. The following are not subject to hospital licensure:

  • A hospital operated by the federal government.
  • A facility providing services under a contract with the Ohio Department of Developmental Disabilities under Ohio Revised Code 5123.18.
  • A facility operated by a hospice care program licensed under Ohio Revised Code 3712.04 and that is used exclusively for the care of hospice patients.
  • A facility operated by a pediatric respite care program licensed under Ohio Revised Code 3721.041 and that is used exclusively for the care of pediatric respite care patients.
  • The site where a health care practice is operated, regardless of whether the practice is organized as an individual or group practice.
  • A clinic providing ambulatory patient services where patients are not regularly admitted as inpatients.
  • An institution for the sick that is operated exclusively as follows:
    • For patients who use spiritual means for healing and for whom the acceptance of medical care is inconsistent with their religious beliefs. 
    • It is accredited by a national accrediting organization, exempt from federal income taxation under section 501 of the Internal Revenue Code of 1986, 26 U.S.C. 1.
    • It provides 24-hour nursing care pursuant to the exemption from the licensing requirements of Ohio Revised Code 4723 described in division (E) of Ohio Revised Code 4732.32.
